Eligibility
To use the platform, you must be a funded trader who has traded with one or more prop trading firms. You must also be at least 18 years old and have the legal capacity to enter into a binding agreement. You are solely responsible for ensuring that your use of the platform complies with all applicable laws and regulations in your jurisdiction.
Registration and Account
To post a review on the platform, you must register and create an account. You must provide accurate, complete, and current information when registering and keep your account information updated. You must not use false or misleading information or impersonate any person or entity. You are responsible for maintaining the confidentiality and security of your account and password and for all activities that occur under your account. You must notify us immediately of any unauthorized access or use of your account or any other breach of security. We reserve the right to suspend or terminate your account at any time for any reason, without notice or liability.
Reviews
As a registered user, you can post reviews on the prop trading firms you have traded with, based on your own personal experience and opinion. You must not post reviews that are false, inaccurate, misleading, defamatory, libelous, abusive, hateful, harassing, threatening, obscene, vulgar, pornographic, or otherwise objectionable or unlawful. You must not post reviews that violate the rights of any third party, including intellectual property rights, privacy rights, or contractual rights. You must not post reviews that contain any personal or confidential information of any third party, such as names, addresses, phone numbers, email addresses, or payment details. You must not post reviews that promote or endorse any products, services, or websites that are not related to the platform or the prop trading firms. You must not post reviews that contain any viruses, malware, or other harmful or malicious code or content.
You grant us a non-exclusive, royalty-free, perpetual, irrevocable, and worldwide license to use, reproduce, modify, adapt, publish, translate, distribute, and display your reviews on the platform and on any other media or platforms, for any purpose, without any compensation or attribution to you. You also waive any moral rights or other rights of publicity or privacy you may have in your reviews.
Intellectual Property Rights
The platform and its original content, features, and functionality are and will remain the exclusive property of propfirmmatch.com and its licensors. The platform is protected by copyright, trademark, and other laws of both United States and foreign countries. Our trademarks may not be used in connection with any product or service without our prior written consent.
Disclaimer
The platform is provided on an “as is” and “as available” basis, without any warranties of any kind, either express or implied, including but not limited to warranties of merchantability, fitness for a particular purpose, non-infringement, or accuracy. We do not warrant that the platform will be uninterrupted, secure, or error-free, that the platform will meet your expectations or requirements, or that the platform will be free of viruses or other harmful components. We do not warrant or endorse the accuracy, completeness, reliability, or quality of any reviews, prop trading firms, trading accounts, or other information or content available on or through the platform. You acknowledge and agree that your use of the platform is at your sole risk and discretion and that you are solely responsible for any loss, damage, or liability resulting from your use of the platform.
Limitation of Liability
To the fullest extent permitted by law, in no event will propfirmmatch.com, its affiliates, licensors, service providers, employees, agents, officers, or directors be liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to damages for loss of profits, revenue, data, goodwill, or other intangible losses, arising out of or in connection with your use of or inability to use the platform, your reliance on any reviews, prop trading firms, trading accounts, or other information or content available on or through the platform, your participation in the incentive program, or any other matter relating to the platform, whether based on warranty, contract, tort, negligence, or any other legal theory, and whether or not we have been informed of the possibility of such damages. Some jurisdictions do not allow the exclusion or limitation of liability for certain damages, so some of the above limitations may not apply to you. In such jurisdictions, our liability will be limited to the maximum extent permitted by law.
Indemnification
You agree to defend, indemnify, and hold harmless propfirmmatch.com, its affiliates, licensors, service providers, employees, agents, officers, and directors from and against any and all claims, damages, liabilities, losses, costs, and expenses, including but not limited to reasonable attorney’s fees, arising out of or in connection with your use of the platform, your breach of these terms and conditions, your violation of any rights of any third party, or your participation in the incentive program, whether or not caused by your negligence or willful misconduct.
Governing Law and Jurisdiction
These terms and conditions and any dispute or claim arising out of or in connection with them or their subject matter or formation (including non-contractual disputes or claims) shall be governed by and construed in accordance with the laws of United States, without regard to its conflict of law principles. You agree to submit to the exclusive jurisdiction of the courts of Delaware, United States, to resolve any legal matter arising from these terms and conditions or your use of the platform. You waive any and all objections to the exercise of jurisdiction over you by such courts and to venue in such courts.
